Update: Long Island Bus Accident Blamed on Jaywalker

We posted yesterday with regards to a tragic Long Island bus accident that took the life of a 6-year-old boy and seriously injured his 7-year-old brother who were both inside their home when a bus crashed through a wall.  The police were still investigating the situation yesterday and at that point they had not determined which party was at fault for the crash.  It seems that they have arrived at their conclusion and that a person who was jaywalking in the street where the bus was driving has been blamed.

According to the authorities, this fatal Long Island bus accident occurred on Tuesday night at approximately 10 p.m.  A bus was driving down Fulton Avenue when the driver noticed a pedestrian wandering into the street.  The bus honked its horn and ultimately swerved in an attempt to avoid the jaywalker, but the pedestrian was hit and the bus veered into the front wall of the home located at 505 Fulton St.  The boy who was killed was inside the wall, and he was mortally wounded by flying debris.  His brother remains in the hospital with serious injuries.  The pedestrian was also injured, and criminal charges could be forthcoming.

Now that fault has apparently been determined with regards to this Long Island bus accident, it seems possible that the family of the boy who was killed could file a New York personal injury lawsuit against that jaywalker in response to the loss of their son and to the injuries suffered by their other child. If such a claim is filed and it’s successful, the family could be awarded damages that compensate them for their different forms of loss.
