Police have reported that a Daily News report has lost his mother after she was struck while crossing a street in Brooklyn. Jeri Pearson was crossing the street at the Putnam Avenue and Bedford Avenue intersection when a motorist turning onto Bedford Avenue struck her. The motorist remained at the scene and has not been ticketed. Pearson was rushed to Kings County Hospital Center where she was pronounced dead.

This is the first fatality at this intersection this year, which saw eight deaths in 2014. The accident is still under investigation.

Pedestrian Fatalities and Wrongful Death Suits

When a pedestrian is struck and killed by a driver, it is possible that the victim’s family could file a wrongful death suit against the driver. To successfully recover compensation in a wrongful death action, the family may have to prove that the driver was at fault for the accident. For example, if the pedestrian was crossing a street in a cross walk in accordance with the designated crossing signal and was hit by a car, the driver could be at fault and could be responsible for damages.

Statistics show that pedestrian deaths account for 10 percent of all traffic-related deaths. When the driver in the accident is at fault, the surviving family can file a wrongful death suit to seek damages. Damages in a wrongful death suit can include:

  • Damages like medical expenses and pain and suffering experienced by the victim from the moment of the accident until death
  • The victim’s lost wages
  • Loss of consortium

If you have lost a loved one in a pedestrian accident, the law is on your side. Typically, only surviving spouses and children can seek compensation in a wrongful death suit. However, if you have experienced the loss of a loved one due to another’s negligence, speak with a personal injury attorney.
